1. Introduction

Welcome to PayBack (referred to as “PayBack,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website and services (collectively, the “Services”). By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Services.

2. Use of Services

  1. Lawful Purposes: You may use the Services only for lawful purposes and in accordance with these Terms.
  2. Prohibited Uses: You agree not to use the Services:
    • In any way that violates any applicable federal, state, local, or international law or regulation.
    • To exploit, harm, or attempt to exploit or harm minors in any way, including exposing them to inappropriate content.
    • To send, knowingly receive, upload, download, use, or re-use any material that does not comply with the Content Standards outlined in these Terms.
    • To deliberately abuse consumer protection laws to receive free products or unjustified refunds from brands.

3. Account Registration

To register for a PayBack account, you must connect (“sync”) your Gmail account. This sync allows PayBack to monitor core data related to your online shopping activity so we can better protect you from deceptive practices. You are responsible for maintaining the confidentiality of your account credentials and for restricting access to your computer or account. You agree to accept responsibility for all activities or actions that occur under your account.

4. Data Sharing

  1. Anonymized Data: To provide consumers with protection, we may share anonymized data with legal partners who can review and assess potential claims.
  2. Data From Email Integration: Via our Gmail integration, PayBack may access information such as:
    • Order numbers
    • Order date and time
    • Order subtotals
    • Merchant website and contact information
    • Products ordered
    • Shipping methods
    • Any other relevant details needed for a licensed legal professional to evaluate potential claims
  3. Contact Information: In some instances, we may share your contact information with legal professionals who can assist you if PayBack is unable to recover your money directly.

5. Payment for Recovered Funds

When PayBack successfully recovers money directly on behalf of a consumer, we charge the consumer’s credit card on file 20% of the amount recovered. Before initiating any recovery on your behalf, you must enter valid credit card information into the PayBack portal. PayBack will only charge authorized payment methods; we do not have the ability to retrieve or use payment information from your online orders.

6. Brand Opt-Out of Automated Recovery

PayBack provides lead generation services for law firms through an automated consumer recovery tool designed to assist consumers who may be eligible for legal action. A brand may opt out of these automated efforts at any time by sending an email to help@getpayback.com with the subject line “Opt-Out for [Brand Name].” The email must come from an authorized address associated with the brand’s domain on record. Once an opt-out request is received and verified, PayBack will cease automated recovery efforts for that brand, and any potential client leads related to that brand will be marketed directly to law firms without delay.

7. Right of Refusal

PayBack’s automated consumer recovery system is offered as a courtesy to give brands an opportunity to resolve disputes and issue refunds without resorting to litigation. Notwithstanding this process, PayBack reserves the right, at its sole discretion and at any time, to cease or decline automated consumer recovery efforts against any brand for any reason. If PayBack discontinues recovery efforts for a particular brand, the relevant cases may be referred or marketed directly to law firms immediately.

8. Intellectual Property Rights

All content, features, and functionality within our Services—including text, graphics, logos, icons, images, and software—are and shall remain the exclusive property of PayBack or its licensors. You may not use our trademarks, trade dress, or intellectual property in connection with any product or service without prior written consent from PayBack.

9. User Contributions

Our Services may include interactive features such as message boards, chat rooms, personal web pages, profiles, forums, or bulletin boards that allow users to post or transmit content (“User Contributions”). All User Contributions must comply with our Content Standards. You bear full responsibility for your User Contributions.

10. Content Standards

These standards apply to all User Contributions and use of any interactive features. User Contributions must comply with all applicable laws and regulations and must not:

  • Contain defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable material.
  • Promote sexually explicit or pornographic material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.

11. Termination

We may terminate or suspend your account—and bar access to the Services—immediately, without notice or liability, at our sole discretion, for any reason, including breach of these Terms.

12. Disclaimer of Warranties

Your use of the Services is at your sole risk. The Services are provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

In no event shall PayBack—nor its directors, employees, partners, agents, suppliers, or affiliates—be liable for any indirect, incidental, special, consequential, or punitive damages, including (without limitation) loss of profits, data, or goodwill arising from your access to or use of, or inability to use, the Services.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Delaware, United States, without regard to its conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts located in Delaware to resolve any legal matter arising from these Terms or your use of the Services.

15. Changes to Terms

We reserve the right, at our sole discretion, to update or replace any part of these Terms at any time. We will determine, in our sole discretion, what constitutes a material change. Your continued use of the Services after any changes indicates your acceptance of the modified Terms.
