1. Introduction
Welcome to Payback. These Terms and Conditions govern your use of our website and services, and by accessing or using our services, you agree to be bound by these terms. If you do not agree with any part of the terms, you must not use our services.

2. Use of Services
You may use our services only for lawful purposes and in accordance with these Terms. You agree not to use:

  • Services in any way that violates any applicable federal, state, local, or international law or regulation.
  • Services for the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content or otherwise.
  • Services to send, knowingly receive, upload, download, use, or re-use any material that does not comply with our content standards.

3. Account Registration
To register a Payback account, you will be required to sync with your Gmail account. This sync allows PayBack to monitor and track core data related to your online shopping that allows us to help protect you from deceptive practices. You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account.

4. Data Sharing
To provide consumers with protection, we will share anonymized data with legal partners who can review and assess any potential claims.

Data we share from your email via our integration may include:

  • Order numbers
  • Order date and time
  • Order subtotals
  • Merchant website and contact information
  • Products Ordered
  • Shipping Method selected
  • And any other relevant information that will allow a licensed legal professional to assess any potential claims

In some instances, will share contact information with legal professionals who can assist you in the event that Payback is not able to recover your money directly.

5. Payment for recovered money
When PayBack is able to recover money directly on behalf of consumers, we will bill the consumer credit card on file for 20% of the money recovered or $5, whichever value is higher.

Before PayBack will recover any money for a consumer, the consumer must enter valid credit card information into the PayBack Portal.

PayBack will only ever bill authorized payment methods and has no ability to pull your payment information from online orders.  

6. Intellectual Property Rights
The content, features, and functionality of our services are and will remain the exclusive property of Payback and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Payback.

7. User Contributions
Our service may contain message boards, chat rooms, personal web pages or profiles, forums, bulletin boards, and other interactive features that allow users to post, submit, publish, display, or transmit to other users or other persons content or materials on or through the services. All User Contributions must comply with the Content Standards set out in these Terms.

8. Content Standards
These content standards apply to any and all User Contributions and use of Interactive Services. User Contributions must in their entirety comply with all applicable federal, state, local, and international laws and regulations. Without limiting the foregoing, User Contributions must not:

  • Contain any material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable.
  • Promote sexually explicit or pornographic material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.

9. Termination
We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

10. Disclaimer of Warranties
Your use of our services is at your sole risk. The service is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Limitation of Liability
In no event will Payback, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.

12. Governing Law
These Terms shall be governed and construed in accordance with the laws of Delaware, United States, without regard to its conflict of law provisions.

13. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion.
