# Terms and Conditions

> The terms that govern your use of Payback, including how recovered funds are paid for.

Disclaimer: PayBack is not a law firm and does not practice law. We cannot provide legal advice or make any legal suggestions. We work with licensed legal professionals and may occasionally share their opinions with consumers and brands. However, such opinions are the professionals’ own and do not constitute legal advice from PayBack.

## 1. Introduction

Welcome to PayBack (referred to as “PayBack,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website and services (collectively, the “Services”). By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Services.

## 2. Use of Services

Lawful Purposes: You may use the Services only for lawful purposes and in accordance with these Terms.

Prohibited Uses: You agree not to use the Services:

- In any way that violates any applicable federal, state, local, or international law or regulation.
- To exploit, harm, or attempt to exploit or harm minors in any way, including exposing them to inappropriate content.
- To send, knowingly receive, upload, download, use, or re-use any material that does not comply with the Content Standards outlined in these Terms.
- To deliberately abuse consumer protection laws to receive free products or unjustified refunds from brands.

## 3. Accounts and available services

You may create a Payback account without connecting Gmail. Receipt monitoring requires a separate Gmail connection. Research buyers do not need Gmail access or lawyer membership. Keep your credentials secure. Availability of lawyer listings, inquiries, membership, sponsorship and research purchasing varies by jurisdiction and approved launch status. Signup alone does not promise access to an unavailable service.

## 4. Customer-selected lawyer inquiries

Signing up or connecting Gmail does not authorize sending your case to a lawyer. Where the directory is available, you may browse named participating firms and deliberately select up to four recipients for a case. Before submission, you see the recipients and the fields you authorize Payback to deliver, and request email contact. No firm is automatically chosen or substituted.

Ordinary listings appear in a random order saved for the case. Clearly labeled sponsored placements receive paid priority visibility and are separate from ordinary ordering. Placement is not a rating of legal ability or a legal recommendation. Firms supply their own profiles. Neither browsing nor submitting an inquiry creates an attorney-client relationship or obligates you to hire a firm.

Inquiries are nonexclusive. You may withdraw permission for further contact through the dashboard. Withdrawal restricts future platform access and requests that the firm stop outreach; it cannot undo information already delivered or override independent legal duties. Consumer permission does not override restrictions attached to data obtained from Google or another source.

## 5. Payment for Recovered Funds

When PayBack successfully recovers money directly on behalf of a consumer, we charge the consumer’s credit card on file 20% of the amount recovered. Before initiating any recovery on your behalf, you must enter valid credit card information into the PayBack portal. PayBack will only charge authorized payment methods; we do not have the ability to retrieve or use payment information from your online orders.

Free refunds and referral credits. Your first recovery through PayBack is free: we charge no fee on it. You also earn one referral credit each time a person you invite with your referral link creates a PayBack account and connects their email inbox. Each credit makes the fee on one later recovery free. Credits are applied automatically to your next recovery, have no cash value, cannot be transferred, and end when your account is closed. We may withhold or remove credits earned through accounts that are not real, separate people, or through messages sent to people who did not ask to hear from you.

## 6. Brand requests about automated recovery

An authorized brand representative may contact help@getpayback.com about automated recovery communications. A brand request does not authorize marketing consumer cases directly to firms, release customer information or bypass customer choice and jurisdiction controls.

## 7. Research and lawyer participation

Payback Research Packages and standalone merchant-data licenses are separately priced factual products. The manifest identifies the purchased version, observation period, source URLs, methodology, limitations and included updates. Public merchant research does not include customer contact information, Gmail receipts or private communications. It is not legal advice or a guarantee of illegality, admissibility, time savings or recovery.

Lawyer participation is governed by separate participation terms and an accepted state rate card: $195 monthly membership, a fixed inquiry rate shared across firms in a jurisdiction, and optional sponsored inquiries at twice that rate in total. Research is optional and is not required to receive the promised basic inquiry. No payment grants exclusivity or a right of first refusal.

Research purchasers receive the license displayed and accepted before checkout for their own investigation and lawful legal work, including permitted sharing with retained counsel, staff and experts for that work. No resale, bulk republication or customer-identification use is authorized. Contact help@getpayback.com about missing, corrupted or materially misdescribed data for correction or refund review. Nonwaivable rights are preserved.

## 8. Intellectual Property Rights

All content, features, and functionality within our Services, including text, graphics, logos, icons, images, and software, are and shall remain the exclusive property of PayBack or its licensors. You may not use our trademarks, trade dress, or intellectual property in connection with any product or service without prior written consent from PayBack.

## 9. User Contributions

Our Services may include interactive features such as message boards, chat rooms, personal web pages, profiles, forums, or bulletin boards that allow users to post or transmit content (“User Contributions”). All User Contributions must comply with our Content Standards. You bear full responsibility for your User Contributions.

## 10. Content Standards

These standards apply to all User Contributions and use of any interactive features. User Contributions must comply with all applicable laws and regulations and must not:

- Contain defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable material.
- Promote sexually explicit or pornographic material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.

## 11. Termination

We may terminate or suspend your account, and bar access to the Services, immediately, without notice or liability, at our sole discretion, for any reason, including breach of these Terms.

## 12. Disclaimer of Warranties

Your use of the Services is at your sole risk. The Services are provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

## 13. Limitation of Liability

In no event shall PayBack, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including (without limitation) loss of profits, data, or goodwill arising from your access to or use of, or inability to use, the Services.

## 14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Delaware, United States, without regard to its conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts located in Delaware to resolve any legal matter arising from these Terms or your use of the Services.

## 15. Changes to Terms

We may update these Terms and identify their current version. Material new participation obligations and rate changes require affirmative acceptance before affected new services. New customer disclosures require a new recipient-specific authorization; continued use alone does not authorize broader sharing of prior Gmail or customer data.
