1. What this license covers
This license governs a Payback price history package: the record of prices Consumer Payback Solutions, LLC (“Payback”) has observed on one online store’s public product listing, delivered as a data file with a written summary, a README and a manifest. The store, the observation period and the files are identified in your order and in the package’s manifest. Version store-price-history-2026-09-21-v1.
By paying for a package you accept this license for that package. Payback grants you a nonexclusive, non-transferable license to use it as set out below. Payback keeps all other rights in the record and in its collection methods.
2. What the record is, and is not
The record is Payback’s own observations of prices, reference (“compare-at”) prices, markdown status and stock status as the store displayed them at the times stated, in UTC. Each observation is a point in time. Days without an observation are gaps, not evidence of anything. The compare-at price is whatever the store published; Payback does not verify it against any other source. Product names and addresses are the latest Payback saw and may have changed over the period.
The record contains no information about any consumer, no receipts, no correspondence and none of Payback’s scores or assessments. The summary counts and describes the observations; it draws no conclusion about the store’s conduct. Nothing in the package is legal advice, a legal opinion, an assessment of legal merit or a statement that any material is admissible or authenticated. Payback is not a law firm and provides no legal services.
3. Permitted use
You may use the package for:
- legal research, case evaluation, litigation, arbitration and regulatory matters, including expert analysis prepared for them;
- internal analysis within your firm or organisation;
- sharing with co-counsel, retained experts, clients in the matter concerned, courts, arbitrators and government agencies, in the course of that work, provided the package’s manifest and this license travel with it or its source is otherwise identified as Payback’s observations.
4. Restrictions
You may not:
- sell, rent, sublicense, publish or otherwise redistribute the package or a substantial part of it, or offer it as a dataset, feed or service;
- use it to build or train a product or service that competes with Payback’s index or packages;
- present Payback’s observations as anything other than observations, or attribute to Payback conclusions the package does not state;
- remove or alter the manifest, the checksums or the attribution to Payback;
- use the package in a way that identifies, targets or contacts any consumer. It contains no consumer information, and Payback will not supply any under this license.
5. Delivery, access period and refreshes
Payback aims to make the package available on your order page within thirty minutes of payment, at any hour, and sends the order link to the email address used at checkout. Files remain available for download from the order page for six months from payment. During that period the package is refreshed about weekly with newer observations; each refresh replaces the files and updates the manifest. Copies you have downloaded remain yours to use under this license after the access period ends.
Download links are short-lived and tied to your order. Keep the order link private; anyone holding it can download the files.
6. Price, payment and refunds
The package is a one-time purchase at the price shown at checkout, currently $429 for one store. It is independent of any Payback membership, directory listing or inquiry. Buying it does not make you a participating firm, does not place you in any directory and does not entitle you to any consumer inquiry. Nothing about the price depends on any case, engagement, outcome or recovery.
If Payback cannot deliver the package, the payment is refunded in full. Once the files have been made available on your order page the purchase is final, except where the law of your jurisdiction provides otherwise.
7. No warranty, limitation of liability
The package is provided as is. Payback does not warrant that the record is complete, continuous or free of error, that any observation reflects what any particular person saw, or that the package is fit for any particular purpose. To the fullest extent permitted by law, Payback’s total liability in connection with a package is limited to the amount paid for it, and Payback is not liable for indirect or consequential loss.
8. Changes and contact
Payback may publish new versions of this license for future packages. The version that governs your package is the one named in its manifest. Questions about a package or this license: help@getpayback.com.
